選舉觀察聲明:選管會必須以危機管理及預防措施應對區選、不應採納政黨建議取消選舉

選舉觀察計劃(下稱我們)歡迎選舉管理委員會(下稱選管會)十月九日的聲明,重申選管會「確保公共選舉在公開、公平和誠實的情況下進行」。然而,我們注意到選管會並無表明排除個別政黨延遲或取消區議會選舉的呼籲。
我們認為,傳媒多番報道政府有考慮上述呼籲,並非巧合;甚至有傳媒引述政府消息人士指:「區議會選舉(投票日)取消與否,會交由選管會決定;但政府亦會在之前發出聲明。
我們嚴正關注選管會在決定取消選舉一事上正在承受越來越大的壓力。在目前社會氛圍之下,政府倘若取消選舉,將被視為保障個別黨派利益的手段。
我們在此提醒選管會主席馮驊,選管會有責任按國際標準和慣常做法,尤其是以保障公民權利和自由為基礎,去支撐一個公開、公平和誠實的選舉。我們相信選管會不欲看見自己作為一個獨立、非政治和中立的法定機構,會因為迎合政府和個別政黨要求取消選舉而令其公信力受損。例如,某種意見認為,俗稱「連儂牆」的海報均為選舉廣告;如果選管會採納上述觀點而要求移除所有海報,將會無差別地把不同意見消音,也損害選管會的公信力。
區議會選舉提名期將於10月17日結束。我們促請選管會再次回應公眾對選舉主任有斷定候選人是否效忠基本法和對特區忠誠、從而宣布其提名是否有效的權力問題。正如我們曾在9月26日致函選管會主席馮驊,選管會應交代清楚:選舉主任能隨意撤銷參選人資格的做法,是否威脅公開、公平和誠實的選舉、貶損區議會選舉的認受性。
最後,正如我們在10月3日的聲明提及,我們促請選管會和相關官員,應和富有經驗的本地和海外觀察員有系統地評估目前和選舉有關的暴力事件,俾能引進恰當的危機管理措施,保障區選安全、順利完成。

EAC Must Step Up Risk Management and Prevention Measures and Reject Growing Calls to Cancel District Council Election by Pro-Government Parties
The Election Observation Project (EOP) welcomes the statement issued by the Electoral Affairs Commission (EAC) on 9 October to reiterate its commitment “to ensure that public elections are held in an open, fair and honest manner.” However, we notice that the EAC has not ruled out or rejected repeated calls by the pro-government parties to postpone or cancel the District Council election.
To our mind, it is not a coincident that the Government has reportedly considered such options, with one government source quoted as saying, “it will be up to the Electoral Affairs Commission to decide whether to cancel the elections [on polling day] but the government will make a statement beforehand.”
We are seriously concerned that the EAC is increasingly pressurized to adopt such a decision (to cancel elections) that will certainly be perceived as yielding to partisan interest.
We would like to remind the EAC Chairman, the Hon Mr Justice Fung Wah, thatit is the EAC’s obligation to uphold electoral integrity according to international standard and practice, including the protection of citizens’ freedoms and rights which are the bedrock of open, fair and honest elections. We do not think the EAC would like to see its credibilityas “an independent, apolitical and impartial body” eroded or its mission compromised by the Government and the pro-government political parties. For example, the EAC will be ill-advised to treat “Lennon Walls” across the city as “Election Advertisements” and proceed to endorse the indiscriminative removals if a wide range of opinions on display.
As the nomination period closes on 17 October 2019, we urge the EAC to address the widespread concerns about the power vested in the Returning Officers to determine whether a prospective candidate “will uphold the Basic Law and pledge allegiance to the Hong Kong Special Administrative Region”. The arbitrariness of the disqualification of prospective candidates by the Returning Officers threatens to subvert “open, fair and honest” elections and undermines the legitimacy of the District Council election.
In line with our statement dated 3 October 2019, we continue to urge the EAC and the officials responsible for managing the elections to engage experienced local and international observers to examine the incidents of election-related violence systematically in order to introduce appropriate risk management and measures to boost electoral security during the District Council election.

RTHK:選舉危機管理委員會已成立 如遇騷亂暴力等或押後區選
政制及內地事務局表示,當局已經成立「2019年區議會一般選舉危機管理委員會」,由選管會主席擔任委員會主席,核心委員包括選管會委員、政制及內地事務局局長、總選舉事務主任、民政事務局及律政司代表等。委員會會向選管會提供意見,如選管會認同委員會的評估,認為相當可能發生騷亂、公開暴力或任何危害公眾健康或安全的事故,會向行政長官建議,押後整場選舉的投票或點票。政制及內地事務局向立法會政制事務委員會提交文件,交代今年區議會選舉應變計劃。根據《區議會條例》及《選舉管理委員會規例》,如果區議會選舉、投票或點票期間,相當可能發生騷亂、公開暴力或任何危害公眾健康及安全的事故、或出現實質不正常情況,或者熱帶氣旋和其他惡劣天氣情況,行政長官、選舉管理委員會或投票站主任可以押後選舉、投票或點票。投票可押後至投票日當天較後時間或押後最多14日,而一貫做法會押後投票至下一個星期日,並於原本投票日中止投票的同一時間,恢復投票,如果可於在同一投票日恢復投票,投票時間會調整或延長,但考慮到選民安全和方便等因素,經調整或延長的投票時間不應超逾午夜12時,意味如果押後選舉的時數超過1.5小時,就應該於另一日恢復投票。
