選舉觀察計劃今日已正式透過傳真，發信予十八區選舉主任，要求對方解釋宣布區議會選舉參選人提名無效（即撤銷參選資格，俗稱DQ)的準則，以及當參選人拒絕簽署「確認書」，會否增加被裁定提名無效（撤銷參選資格）的風險。
過去幾次立法會和鄉事委員會選舉，不少參選人均被選舉主任以不同理由裁定提名無效。選舉觀察認為，為保障選舉制度公平、公開、公正，當局有必要清楚交代裁定參選人提名無效的準則和原因。

今日有報道引述行政長官林鄭月娥回應與選舉安全相關的提問時，「承認當局正研究不同應對方案，包括押後區選，但林太質疑『押後14日又有乜用』，故不排除取消該選區選舉，甚至連帶取消所屬區議會其他選區選舉。」（註）
選舉觀察計劃留意到，近期已經不只一次傳出政府會取消或押後11月24日區議會選舉的「消息」，我們擔憂此等說法變相鼓勵破壞選舉，為剝奪市民的選舉權利製造藉口。

In the news today the Chief Executive Carrie Lam is reported to have responded to concerns about public order on the polling day by suggesting that “the authority is considering various plans, such as the postponement of the District Council Election, but as she questioned that 'fourteen days of postponement is essentially useless' it did not rule out the possibility of cancelling the election of affected constituencies, maybe even the elections of other constituencies in the same district”.
The Election Observation Project has noticed that the government has been repeatedly urged to postpone or cancel the DC Election to be held on 24 November. We are worried that claims about possible disruptions to the election are used as a pretext for depriving citizens of their electoral rights.
We therefore call on public figures not to spread speculations or rumours about disorder or disruption on the polling day. We urge the government to safeguard the integrity and the impartiality of the election process as a priority, and avoid making remarks that will undermine public confidence in the election.

【明報專訊】10多名建制派議員昨日約見特首林鄭月娥，討論反修例風暴。據了解，席上有議員關注11月區議會選舉的公正性問題，有人擔心泛民會包圍投票站，林太稱為保選舉公平公正，正研究不同應對方案，包括押後選舉，亦不排除取消該區選舉，甚至是取消所屬區議會其他選區選舉。民建聯蔣麗芸在會後稱，會上向林太提出考慮引用《緊急規例條例》設立有「日落條款」的《反蒙面法》，在非法集會、遊行或暴亂場合啟動，減低蒙面後的不理性行為，以止暴制亂。
近期已有多次針對區議會相關的政治人物的受襲事件，包括早前元朗區議員鄺俊宇受襲，以及不同派別的區議員辦事處受到毀壞。選舉觀察計劃已展開整理與選舉相關的暴力事件的檔案。

應邀請國際選舉觀察團來港
並確保選舉順利進行
2019年區議會選舉的提名期將於明天（10月4日）開始，選舉觀察計劃注意到有政黨已經不只一次以選舉「不安全」為理由，促請政府考慮取消選舉。亦有政黨認為現時沒有足夠理由取消或延遲選舉，質疑取消選舉的建議只是因為有政黨擔心選情，純粹為了避免敗選才提出。
國際比較研究指出，選舉暴力的起因包括政治制度缺陷和價值及身分衝突。然而，國際研究同時強調，政府——尤其是負責選舉管理的機構、參選人及參選團體有共同責任，採取相應措施和原則，防止選舉暴力發生；至於非政府組織，例如獨立運作的本地和國際選舉觀察機構則負有推動和平選舉及監察的作用。
我們必須指出，政府倘若取消11月24日的區議會選舉，等同剝奪香港市民用選票表達不同意見的機會，將會嚴重削弱選舉權和被選舉權，以及損害相關的基本人權和自由，結果很可能會激發更多更嚴重的社會衝突，與阻止暴力蔓延的目標適得其反，故有關建議絕不可取。
而且，根據《區議會條例》，行政長官並沒有權力取消區議會選舉，或取消任何選區的選舉，只可以按照該條例第38條在特定的情形下將「選舉、投票、或點票」押後14天。
我們認為，政府和參加選舉的人士既不應為取消區議會選舉找藉口，特區政府應盡快向社會澄清，行政當局可以考慮取消選舉的說法亦無法律依據。因此，政府更應致力保障選舉公正，令選舉能有效如期進行。
就此，我們有兩點呼籲如下：
1）政府應邀請國際選舉觀察團來港分享經驗和給予相關意見，觀察是次選舉；及
2）政府有關部門、選舉管理委員會、和所有有意參與區議會選舉的人士須在《區議會條例》相關規定範圍內商討各方關注的問題，確保選舉順利完成。

A lawyer by training, Miroslaw Adamczyk was Consul-General of Poland in Hong Kong and Macau from April 2014 to September 2019.
2. Prof. Michael C. Davis, Global Fellow at the Woodrow Wilson International Center for Scholars in Washington, DC.
Michael C. Davis (戴大為) is the Professor of Law and International Affairs at India's O.P. Jindal Global University, a Senior Research Scholar at the Weatherhead East Asia Institute at Columbia University, and a Global Fellow at the Woodrow Wilson International Center for Scholars in Washington, DC. Until stepping down in 2016, he was professor in the Law Faculty at the University of Hong Kong, where he remains a non-resident senior fellow in the Centre for Comparative and Public Law.
3. Prof. Victoria Hui, University of Notre Dame, USA
Victoria Tin-bor Hui is Associate Professor of Political Science at the University of Notre Dame. She focuses on comparative history of Asia and Europe, state formation and state-society relations, contentious politics and resistance movements, transformation of world politics, political culture, Asian and Confucian values, and Chinese politics.
As a native of Hong Kong, Hui also analyzes Hong Kong politics. She testified at Congress, has maintained a blog “The Umbrella Movement and Beyond,” and has published an article “Hong Kong’s Umbrella Movement: The Protest and Beyond” in the Journal of Democracy.
4. Prof. Marie Mendras, Sciences Po – CNRS, Paris
Marie Mendras is a specialist of Russian and post-Soviet studies. She is a research fellow with the Centre national de la recherche scientifique (CNRS) and a professor at Sciences Po’s School of International Affairs in Paris.
Between 1991 and 2014 Mendras served as Election Observer, with the OSCE, the French Parliament, or other institutions, to monitor presidential and legislative elections, and constitutional referendum in Russia, Ukraine, and Armenia.
Mendras was a Visiting Scholar at the Department of Government and International Studies, Hong Kong Baptist University during the Second Semester 2018/2019.
5. Prof. Pippa Norris, Harvard University and Electoral Integrity Project, USA
Pippa Norris, is Founding Director Electoral Integrity Proejct, Laureate Professor of Government and International Relations, University of Sydney and McGuire Lecturer in Comparative Politics, Harvard University. Her research compares electoral integrity, public opinion and voting behavior, democratic institutions and cultures, gender politics, and political communications in many countries worldwide.
Recent books published include Strengthening Electoral Integrity (CUP 2017), Election Watchdogs (edited with Alessandro Nai, OUP 2017), Checkbook Elections: Political Finance in Comparative Perspective (ed. with Andrea Abel van Es, OUP 2016), Why Elections Fail (Cambridge University Press 2015), Contentious Elections: From Ballots to Barricades (Routledge, ed. with Richard W. 選管會發言人說：「十一月二十四日舉行的區議會一般選舉，是一個非常重要的平台，讓413萬多名已登記選民投票選出其代表。」
他表示，留意到近日社會上有暴力事件接連發生，包括有公眾人物受襲、議員辦事處被毀壞等。香港一直有良好的選舉文化，選管會絕不希望選舉中出現任何威嚇或暴力的情況。選管會如接獲有關投訴會轉介執法機關跟進。」
假如有人對選舉安排有任何不滿，可作出投訴或依法律程序提出選舉呈請處理爭議。
"The District Council Ordinary Election to be held on November 24 is an important platform for over 4.13 million registered electors to elect their representatives," said the spokesman for the EAC.
He added that the EAC is aware of the successive occurrence of violent incidents in society recently, including assault of public figures and vandalisms of offices of members of the Legislative Council and District Council. Hong Kong has all along had a very good election culture. The EAC does not want to see any threats or violence in the election. If any such complaints are received, the EAC will refer them to the relevant law enforcement agencies for follow-up action.
If anyone is not satisfied with the electoral arrangements, they can make complaints or make election petitions through judicial proceedings to resolve the disputes.

He added that the EAC is aware of the successive occurrence of violent incidents in society recently, including assault of public figures and vandalisms of offices of members of the Legislative Council and District Council. Hong Kong has all along had a very good election culture. The EAC does not want to see any threats or violence in the election. If any such complaints are received, the EAC will refer them to the relevant law enforcement agencies for follow-up action.
If anyone is not satisfied with the electoral arrangements, they can make complaints or make election petitions through judicial proceedings to resolve the disputes.
