香港電台報道：由浸大及民權觀察組成的選舉觀察計劃表示，選管會有責任為選舉主任提供清晰的指引和建議，杜絕對候選人進行與法律要求不相關的政見篩選和思想審查。選管會回應說，提名是否有效由選舉主任按法例要求決定，選管會無權，並一向沒有參與，亦不會給予任何意見。

選管會說，不會就提名是否有效向選舉主任作出指引，只會按選舉主任裁定提名有效的候選人名單安排選舉，而選舉主任裁定參選人是否有效時，亦受相關法律約束。

另外，選管會表示，一如既往的大型公共選舉，應變計劃包括可成立危機管理委員會，就惡劣天氣、公眾健康或安全等可能影響選舉進行的事宜，向選管會提供意見。

選舉觀察成員陳家洛昨日在明報撰文，分析煞停區選對選舉公正和公民權利的影響：

「如果選管會主席和委員不欲看見自己作為一個獨立、非政治和中立的法定機構，要為迎合政府和個別政黨要求去押後甚至同意取消選舉而令其公信力盡失，選管會就必須改變做法，不能只將「公開、公平和誠實的選舉」作為一句口號般重複出現在它的聲明。國際經驗和比較研究已證實，面對選舉暴力，機能提升（capacity building）和公眾參與（public engagement），所謂硬件和軟件要互相配合，缺一不可。選舉管理工作的宗旨，在於保障選舉中公民的權利和自由，對針對候選人的暴力進行具體研判及風險評估，並採取預防及紓緩（prevention and mitigation）的措施，具體情况具體處理，也要有清晰透明具公信力的應變計劃，避免公眾對選舉舞弊產生觀感和猜疑。」

【選舉觀察計劃回應馮驊「香港家書」】



選舉管理委員會主席馮驊今天（11月16日）在香港電台讀出「香港家書」，選舉觀察計劃對選管會致力確保11月24日區議會選舉如期舉行的態度表示歡迎，惟我們認為「家書」內容空泛，未有就今天的情況提出有力的建議。

近期警方在各區大規模驅趕及拘捕市民，包括多名區議會選舉候選人公開聲稱遭無理拘捕及在拘留期間被警員毆打，選舉觀察計劃認為事態嚴重，對候選人和市民的選舉權利構成嚴重威脅，亦關注傳媒工作者、市民及候選人的權利完全得不到警方的尊重。

選舉觀察計劃成員陳家洛昨天（11月15日）去信選舉管理委員會主席馮驊，要求委員會交代11月24日投票日是否有機制保障被捕的市民和候選人的權利，並要求他向警務署長提出警方行動有構成選舉不公的可能（全文見下）。我們亦認為，在官民互信基礎薄弱的今天，選舉管理委員會必須提高選舉管理工作的透明度，包括主動公開其票站管理人員培訓手册、增加「危機管理委員會」的透明度和問責度，以期增強市民及候選人對選舉能否公正地進行的信心。

Hope this email finds you well.

I am writing to inquire about the polling arrangement for eligible voters and candidates who are under arrest and detention by police on 24 November 2019.

The Electoral Affairs Commission has already announced that there will be mover 600 ordinary polling stations and 23 dedicated polling stations (prisons).

However, there are growing concerns that those arrested / detained in police stations or designated detention centres on the polling day will have their rights as voters and candidates violated altogether.

I should therefore be grateful if you could address such concerns and liaise with the Police Commissioner as to how the rights of eligible voters and candidates are not violated by police operations.

In my view, the crisis management mechanism that EAC has recently set up suffers from low transparency and low accountability. Against this background we are concerned that measures to be introduced by the EAC's crisis management committee will adversely affect public perceptions about electoral fairness and integrity.

Given the unprecedented level of mistrust in our society, we will urge you to publish your "internal" Guidelines and manual so as to engage members of the public and candidates in full to enhance electoral integrity.

【選舉觀察計劃回應政制及內地事務局局長聶德權權：押後選舉，政府有最大責任】

選舉觀察計劃對政制及內地事務局長聶德權今日有關押後選舉的言論表示極度遺憾。

誠然，一個自由公平的選舉，必須確保選民能夠安全無阻前往票站投票。然而，聶德權提出三個選舉如期舉行的條件——包括立即停止暴力及威嚇，隧道幹線及道路必須不被堵塞，以及停止破壞交通設施，避免交通癱瘓——卻完全是倒果為因、諉過於人。

由六月以來的暴力及威嚇事件，除了來自部分激進示威者，更多來自香港警察使用過度武力清場、隨意濫捕市民，更在黑社會襲擊市民時消失無蹤，激化暴力、製造恐慌。由上星期警察進攻大學校園起，警方武力和激烈程度毫無減退跡象，而當局至今完全沒有提供選舉日警察如何自我制約，避免令投票市民感受威嚇（參見選舉觀察計劃中期報告），縱容選舉暴力種子，完全是不負責任。

國際經驗啟示，不民主政體下的選舉，當權者往往因懼怕選舉結果而用盡方法阻止選舉能自由公平地進行。我們認為，政府要確保選舉如期舉行，就應當機立斷，製造社會降溫條件，改變以武力鎮壓威嚇民眾的手法，盡快以和平方式處理當前的政治危機，保障區選如期舉行。否則，選舉一旦被押後，市民無法投票，最大的責任一定來自特區政府。

同時，我們呼籲社會各界，共同以人道關懷和保障人權出發，盡力紓緩目前的政治與人道危機。

[投票日觀察選區安排]

選舉觀察計劃在星期日區議會選舉投票日(24/11) 將會派出觀察隊伍，在選舉日期間走訪不同選舉觀察投票站外情況。我們將按人手和現場情況決定觀察選區數目。

我們有興趣觀察的選區名單可參見附圖。

選舉觀察員屆時會穿上佩有本計劃標誌的白色T-shirt 在選區範圍進行觀察，並不會接受傳媒採訪。同時，本計劃亦會定時派員到三個專用投票站（跑馬地警署、長涉灣警署及田心警署）外未被禁止的位置進行觀察。

本計劃在選舉日當日亦會繼續運作報料熱線，讓市民以及候選人團隊提供有關選舉違規及影響公正事宜之文字描述及親自記錄的多媒體資料。
