■TE Holds a research validation workshop related to transparency and accountability in the extractive sector■

A successful research validation Workshop has been held on ‘How the Mining Process is implemented in Ethiopia and its Impact on the Community and the Country: the Case of Oromia and Benishangul Gumuz Regional States’ at Sapphire Addis Hotel on Thursday April the 28th, 2022.

The workshop brought together a diverse group of 65 participants who represented various partner civil society organizations and governmental bodies such as the FDRE Ministry of Mines (EEITI in particular), Ethiopian Bio-Diversity Institute, Geological Survey of Ethiopia, and Wild life Conservation Authority.

At the event, Ato Samuel Kassahun, TE's Executive Director, delivered a key note speech in which he made a general introduction about TE’s efforts to combat corruption and promote good governance in all public sectors. He emphasized that TE’s contributions in the fight against corruption are intended to have a ripple/droplet effect in the general multi-stakeholder struggle against corruption. He noted that “…the small pebbles we throw today will grow to be a huge rock that would be able to eventually crush the monster called corruption”. He explained the strategic pillars of TE where he noted that the day’s topic falls within the public accountability pillar of TE. Finally, having presented some initiatives related to transparency and accountability in the mining sector such as the EITI, Ato Samuel noted that there has been little success in the area so far and that much effort is expected from stakeholders.

Ato Merga Kenea from the Ministry of Mines(EEITI),in his opening remark,  appreciated the overall contributions of TE in the area and commended the fact that such an important research is commissioned by TE. He briefly outlined efforts by the FDRE Ministry of Mines (particularly the EEITI) over the past 12 years.
He concluded by emphasizing that mining is the second most important sector in terms of revenue generation in Ethiopia and all stakeholders particularly CSOs have an immense role to play in the effort to promote accountability and transparency in such an important sector.

At the end of the workshop, Samuel Kassahun ,TE's Executive Director, noted that Inputs/feedback from the participants will be incorporated in the final draft before the report will be ready for dissemination to various stakeholders and the wider public.

ሙስና ከባድ የስነ ምግባር ደንብ ጥሰት ተግባር መሆኑ ተገለጸ

የፌዴራል ከፍተኛ ፍርድ ቤት ምክትል ፕሬዚዳንት ክቡር አቶ ተኽሊት ይመሰል ለዳኞች በተዘጋጀዉ በዳኝነት አካል ዉስጥ የሚታዩ የሙስና ተግባራት መከላከያና መቆጣጠሪያ ሰትራቴጂ ስልጠና መድረክ ላይ ባደረጉት ማጠቃለያ ንግግር ሙስና ከባድ የስነ ምግባር ደንብ ጥሰት ተግባር መሆኑን ተናግረዋል፡፡

ምክትል ፕሬዝዳንቱ አያይዘዉም የፌዴራል ዳኞች ስነምግባር ደንብ ቁጥር 1/2013 አንቀጽ 8(3) መሰረት ዳኞች የዳኝነት ስልጣናቸዉን በመጠቀም እራሳቸዉን ለማበልጸግ እንዲሁም ለሶስተኛ ወገን ያልተገባ ጥቅም እንዲያገኝ ማድረግ እንደማይችሉ የሚደነግግ መሆኑን አንስተዉ፣ፍርድ ቤት ነጻነቱ የሚጠበቅ፣ ያጠፋ የሚጠየቅበት ተቋም መሆን እንዳለበትና ይህንንም ለማድረግ በቀጣይ ትኩረት ተሰጥቶ የሚሰራበት መሆኑን ገልጸዋል፡፡

ሙስናን ለመታገል ዳኞች ሊከተሏቸው የሚገቡ መርሆች እና ተጠያቂነት የሚያስከትሉ ጥፋቶችን የተመለከተ የዳኞች የስነ-ምግባር ደንብ የሚደነግግ መሆኑን ያነሱት ምክትል ፕሬዝዳንቱ በንግገር ብቻ ሳይሆን በአደረጃጀት፣ የአሰራር ስረዓት በመዘርጋት እና መሰረታዊ ግብዓቶችንም ማሟላት የሚጠይቅ ተግባር ነዉ ሲሉ አብራርተዋል፡፡

ምክትል ፕሬዝዳንቱ አክለዉም እንደ ሀገር ፍትህ የሚጠየቅበት ተቋም ፣የዳኝነት ሞያዉ በሌሎች ሶስተኛ ወገኖች ጣልቃ ገብነት አለያም ቁጥጥር ዉስጥ እንዳይገባ ሙስናን አጥብቆ መታገል የሚያስፈልግ መሆኑን ጠቅሰዉ፤ ህዝብ ማገልገል ትልቅ ክብር በመሆኑ በንጹህ እጅና ህሊና ነጻ፣ገለልተኛና በህዝብ የታመነ ተቋም እንዲሆን በከፍተኛ የኃላፊነት ስሜት መስራት ይገባል ሲሉም መልዕክታቸዉን አስተላልፈዋል፡፡

የፌዴራል ከፍተኛ ፍርድ ቤት ምክትል ፕሬዝዳንት ክብርት ወይዘሮ ተናኜ ጥላሁን በበኩላቸዉ በስትራቴጂ ሰነዱ ላይ በበቂ ሁኔታ ዉይይት የተደረገባቸዉና የተነሱ ሀሳቦችም ለቀጣይ የስራ አቅጣጫ ተደርጎ የሚሰራበት መሆኑን አንስተዉ፣ በፍርድ ቤት የሚታዩ የሙስና ተግባራት ላይ የፍርድ ቤቱ አመራሮች ፣ዳኞችና የዳኝነት ማህበረሰቡ በንቁና በተደራጀ መልኩ መታገል እንዲችል በማድረግ የሙስና ተግባራትን በመቆጣጠር የህዝብ አመኔታን ያተረፈ ተቋም መገንባት የመጨረሻ ግብ መሆኑን ገልጸዋል፡፡

የመርሃ ግብሩ ተሳታፊዎች በቀረበዉ ሰነድ ላይ በተዘጋጀዉ የመወያያ ነጥቦች ላይ በአራት ቡድን ተከፋፍለዉ ዉይይት በማድረግ በዉይይት የተነሱ አንኳር ነጥቦች ለዳኞች ያቀረቡ ሲሆን የክስና መልስ አዘገጃጀት የተሟላና ግልጽ ያለመሆን፤ የዳኞችን ፍቃድ ስልጣን መስፋት ዳኞች ያልተገባ ተግባር ሊፈጽሙ እንደሚችሉ፤ ዳኞች ክርክር ሲመሩ የተሟላ የማያዳግም የተጠቃለለ ትዕዛዝ የመሰጠት ችግር መታየቱና የጉዳዮች መጓተት እና በተደጋጋሚ መቅጠር ለሙስና ሊያጋልጡ የሚችሉ ጉዳዮች መሆናቸዉን በዉይይት ከተነሱ ነጥቦች የሚጠቀሱ ናቸው፡፡

ለዳኞች ትምህርታዊ ጉባዔዎችን በማዘጋጀትና ተመሳሳይና ወጥ የሆነ የህጎች አተረጓጎም እንዲኖር አለማድረግ፣ ግልጽ የሆነ የአሰራር ስርዓት ያለመዘርጋቱና የመዝገብ አከፋፈት አለመዘመን ለሙስና አጋለጭ ነገሮች መኖራቸዉን ያነሱት ተሳታፊዎቹ የሙስና ተግባርና አመለካከትን ለመዋጋት ሁሉም በግሉ እራሱን በመመርመርና ከተጋለጭነት በመራቅ የህዝብ አመኔታን ያተረፈ ፍርድ ቤት ለመገንባት ሁሉም ሊረባረብ ይገባል ሲሉ በዉይይቱ ማንሳታቸዉን ካቀረቡት ሪፖርት ለመገንዘብ ተችሏል፡፡

ተሳታፊዎቹ አክለዉም የዳኝነት ነጻነትን ባከበረ መልኩ ተጠያቂነትን የዳኞች አስተዳደር ጉባኤ በዘረጋው የአሰራር ሥርዓት በማረጋገጥ የሙስና ተግባራትና ተጋላጭነትን ለመከላከልና ለመቆጣጠር የተዘጋጀዉ ሰነድ በተሰጡ ግብዓቶች ዳብሮ ተግባራዊ ማድረግ በፍርድ ቤቶች እየተነሱ ያሉ የስነ-ምግባር ችግሮችን ለመቅረፍ እንደሚረዳ ገልጸዋል፡፡

የፌዴራል ከፍተኛ ፍርድ ቤት ከዳኞች አስተዳደር ጉባኤ ጋር በመተባበር በቢሾፍቱ አዱላላ ሪዞርት ለሁለት ቀናት ሲካሄድ የቆየዉ የዳኝነት አካል ዉስጥ የሚታዩ የሙስና ተግባራት መከላከያና መቆጣጠሪያ ሰትራቴጂ ስልጠና እና የዉይይት መድረክ ሙስናን ለመዋጋት የሚያስችሉ አሰራሮችና የስራ አቅጣጫ ላይ የጋራ ዉይይት በማድረግ ተጠቃሏል፡፡

Transparency Ethiopia welcomes a step in the right direction in the area of Corporate Social Responsibility

Ministry of Mines and Ministry of Finance have given 113 million birr to the Somali regional government collected from companies exploring oil the region.

The 'societal development money' shall be spent on projects to support health, education, road and other infrastructural developments.
Takele uma, Minister of Mines, stated in his personal social media page that "our mining development plan is to link the source society (from which mining related wealth is generated) to the mining development in the area".

Transparency Ethiopia has been advocating for a Corporate Social Responsibility framework in Ethiopia. TE has also been working to sensitive various stakeholders on the Social and environmental impact of mining including the commissioning of a ground breaking research on the topic.

Transparency Ethiopia gives training to Journalists and Government Communicators

A training focusing on how to conduct and give effective interview has been given to Journalists from various media houses and government communicators (Public relations officers) from several government ministries. A total of 36 high level journalists and government communicators participated during the training workshop.
Ato Samuel Kassahun, Executive Director of Transparency Ethiopia, noted during his opening speech that the nature of corruption in the country is systemic and pervasive and that media is an important stakeholder and partner in the fight to curb corruption. The media has not only the role of informing the public but also is expected to play a vital role as a watchdog checking the responsibilities and functions of public officials. Ato Samuel underlined the necessity of strengthening investigative journalism, among other means, in the fight against corruption. Although the media is supposed to involve at a higher level in the fight against corruption, he said, it has not been as effective as expected in the Ethiopian context. Discussing the theme of the day, he noted that the antagonistic relationship between journalists and government communicators needs to be replaced with an understanding that they are complementary professions.
The general purpose of the training was to contribute to the development of a smooth the relationship between the two important categories of professionals and also equip them to conduct and give effective interviews. Mulatu Alemayehu (PHD) and Yohannes Shiferaw (PHD), both assistant professors at Addis Ababa University, provided theoretical training during the first half of the session to the journalists and the PR officers respectively. The second half was devoted to practical session which brought together both professionals. The participants, noting the importance of the platform, applauded TE for taking such an initiative and encouraged TE to hold similar workshops in the future.

Ato Samuel, remembering that a similar workshop had been held earlier, promised that TE shall continue creating similar platforms in the future.
